Privacy Principles and Agreement

Parties: This agreement is entered into between Cebir Giyim San. ve Tic. Ltd. Şti., registered at Mahmutbey Merkez Mahallesi, 2567. Sokak No:6, 34218 Bağcılar/Istanbul (hereinafter referred to as “Maraton”), and the Customer, who is a registered member of the website www.maratonsw.com and/or its mobile application (hereinafter referred to as the “Website and/or Mobile Application”).

Maraton respects the privacy of its customers and makes every effort to protect personal data and information in accordance with all applicable data protection legislation.

1. Agreement

Once the Customer completes the registration process on the Website, they may begin using the Website or Mobile Application by entering their email address and password, provided they comply with the terms set forth in this agreement.

If the agreement is entered into on behalf of a legal entity, the individual executing the agreement declares and undertakes that they are authorized to act on behalf of said entity. Otherwise, in the event of unauthorized action, the individual shall be personally liable for all legally binding transactions performed or to be performed. In such cases, Maraton shall bear no responsibility.

By accessing and using the Website and/or Mobile Application, the Customer is deemed to have accepted all terms of this agreement, which shall be binding upon them.

2. Customer Rights and Obligations

The Website and/or Mobile Application is publicly accessible and free to use. By using the Website and/or Mobile Application, the Customer agrees to comply with all terms outlined in this Agreement and any rules specified within the Website and/or Mobile Application.

While benefiting from the services offered, the Customer agrees to abide by all applicable laws and regulations, including but not limited to the Turkish Code of Obligations, Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Trademark and Patent Protection Laws, relevant Decrees, and any announcements or notifications published by Maraton regarding its services.

Any legal, criminal, or financial liability arising from misuse or violation of these laws and notifications shall be borne solely by the Customer. If Maraton is required to make any payments to third parties due to the Customer’s actions, Maraton reserves the right to recover such costs from the Customer.

The Customer shall not engage in any activity that prevents or hinders other users or visitors from accessing the Website and/or Mobile Application. The Customer may not overload servers or databases using automated programs, attempt to manipulate data, or engage in misleading behavior. Such actions may result in termination of membership, and the Customer accepts full legal and criminal liability for any consequences. Maraton shall not be held liable in such cases.

The Customer declares that all personal and other information provided during registration or purchase is accurate. If any information is found to be incorrect, the Customer agrees to compensate Maraton for any resulting damages immediately. If payments are made to third parties due to this, the Customer shall also reimburse Maraton for those losses.

All visual and textual content provided on the Website and/or Mobile Application is for personal use only. Unless otherwise stated, all rights to texts, graphics, photographs, videos, animations, and audio content are reserved and may not be used for commercial or personal purposes without permission.

It is strictly prohibited to publish or link any content from the Website and/or Mobile Application on other platforms or websites without Maraton’s written consent. Maraton reserves the right to take legal action against any violations.

The Customer may not use, resell, share, distribute, display, copy, reproduce, modify, or create derivative works from any copyrighted material on the Website and/or Mobile Application without Maraton’s written approval. The Customer accepts full liability for any damages incurred or that may be incurred by Maraton due to such violations.

The Customer may unsubscribe from the email list at any time.

3. Maraton’s Rights and Obligations

In the following cases, Maraton reserves the right to cancel transactions, suspend access, or unilaterally terminate this Agreement, in addition to any legal rights granted by law. In such cases, Maraton’s records shall be considered conclusive evidence:

If incorrect, incomplete, misleading, or inappropriate content is submitted that violates public morality or Turkish law
If any content or data from the Website and/or Mobile Application is copied or attempted to be copied in whole or in part
If software or activities are used that threaten the general security of the Website and/or Mobile Application or disrupt its functionality
If Customer credentials (e.g., username, password) are shared with third parties, resulting in unauthorized use

The Customer is solely responsible for any misuse of their credentials. Similarly, the Customer may not use another person’s IP address, email address, username, or other information, nor access or use other users’ private data without authorization. Any legal or criminal liability arising from such actions shall rest entirely with the Customer.

In all such cases, Maraton’s records shall be considered binding and conclusive. Maraton shall not be held legally or criminally liable.

To ensure service continuity, Maraton reserves the right to make unilateral changes to this Agreement at any time without prior notice and may suspend or discontinue services temporarily or permanently.

The validity, interpretation, and execution of this Agreement are governed by the laws of the Republic of Turkey. Any disputes arising from the implementation of this Agreement shall be resolved by the courts and enforcement offices of Bakırköy, Istanbul.

By registering on the Website and/or Mobile Application, the Customer confirms that they have read and understood this Privacy and Data Security Policy and explicitly consents to the storage, processing, international transfer, and protection of their personal data as described herein.
